The Odisha Labour Department has announced that women employees can now work night shifts in private shops and commercial establishments, provided they give written consent. This decision follows the withdrawal of Section 23 of the Odisha Shops and Commercial Establishments Act, 1956.
To ensure the safety and welfare of women, certain conditions have been mandated. Written consent is required from women employees before assigning night duties. Transportation with GPS tracking must be arranged for pickup and drop from their residences.
At least three women employees and one female supervisor must be present at the workplace. Proper facilities like toilets, drinking water, adequate lighting, rest rooms, and CCTV surveillance must be ensured.
Vehicles used for women's commute must prominently display the helpline numbers 181 and 18003456703. The appointed drivers must undergo police verification.
There must be a minimum rest period of 8 hours between a day and a night shift. Strict adherence to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act is mandatory.
Employers engaging women in night shifts must submit a self-certification on the Labour Department portal confirming compliance with all safety provisions. Any violation will invite action under Section 35 of the Odisha Shops and Commercial Establishments Act, 1956.
